Report Terms: Buyer's Price and Risk Report
1. The service
Envisage Property Pty Ltd 78641926374 agrees to prepare a Buyer's Price and Risk Report for the property you nominate, for you as the named purchaser. The report is a desk assessment: it is prepared from public records, portal data and photographs supplied by others, without any physical inspection of the property. It provides a price opinion and estimated selling range together with risk findings from public sources. It is not a valuation.
2. Your acknowledgements (required before purchase)
By ticking the box at checkout you acknowledge that:
• the property will not be inspected in preparing the report, and matters not visible in photographs or public records (including building condition, structural and drainage issues, pest damage and moisture) are outside its scope and can materially affect value;
• the report is a price opinion, not a valuation, and is not for lending, tax, family law, deceased estate or duty purposes;
• the report is preliminary research and general information only. It is not legal, financial or investment advice and does not take account of your objectives, financial situation or needs;
• no buyer's agent is appointed under this purchase, and you will obtain a building and pest inspection and your own legal and financial advice before going unconditional;
• the sources the report draws on (government registers, portals, mapping services) can be incomplete or out of date, and the report records what those sources showed at the report date.
3. The report is personal to you
The report is prepared solely for the named purchaser and for the nominated property. It may not be assigned, transferred, resold or provided to any other person for their reliance, and no person other than the named purchaser may rely on it. You may share it with your own professional advisers (solicitor, conveyancer, building inspector) for the purposes of your purchase.
4. Currency and expiry
The report reflects information available at the report date stated on its face and is not monitored or updated afterwards. It is valid for 30 days from the report date; after that, market movement and new information mean it should not be relied on, and a refreshed report is a new engagement.
5. Fees, refunds and consumer guarantees
The fee is payable at checkout and covers the preparation and delivery of one report on one property. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. To the extent permitted by law, and where it is fair and reasonable, Envisage's liability for a failure to comply with a consumer guarantee in connection with the report is limited to supplying the report again or refunding the fee.
6. Our interest
Envisage Property is a buyer's agency. Where a report identifies open items, it may note that Envisage offers paid engagements to assist. Envisage has a commercial interest in being engaged; the report's findings and price opinion are produced by a standing methodology that does not vary with that interest.
7. Delivery and use
The report is delivered as a PDF to the email address you provide. You receive a licence to use it for your personal, non-commercial purposes in connection with the nominated property. It may not be published, reproduced for third parties, or used in marketing, lending or legal proceedings.
8. Your information
The details you provide (your name, the property address, your contact details) are used to prepare and deliver the report and to maintain Envisage's records, and are handled in accordance with Envisage's privacy policy https://www.envisageproperty.com.au/privacy-policy
9. Problems and contact
If the report contains an error or you believe it does not answer its stated scope, contact support@envisageproperty.com.au within 7 days of delivery and Envisage will review and, where warranted, reissue it. This process does not limit your rights under the Australian Consumer Law.
10. General
These terms are the entire agreement for the supply of the report and are governed by the laws of the Australian State or Territory in which you are located, and you and Envisage submit to the non-exclusive jurisdiction of the courts of that State or Territory. If any part of these terms is unenforceable, it is severed and the rest remain in force.
